Terms of Service

By creating an account or using cloud.virtuino.com ("the Service", "Virtuino Cloud"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users — free (Hobby plan) and paid subscribers alike. We reserve the right to update these terms at any time; continued use of the Service after changes constitutes acceptance.

Virtuino Cloud is a cloud-based IoT platform that provides:

• MQTT broker and HTTP REST API for connecting hardware devices
• Sensor data storage, querying, and real-time visualization via dashboards and widgets
• Automation scripts, rule engines, and schedulers running in the cloud
• Multi-tenancy sub-accounts, dashboard sharing, and white-label branding options
• Email and push notification delivery for device events

The Service is provided on a subscription basis. Feature availability depends on your active plan. Plan limits (variables, data points, sub-accounts, etc.) are defined at cloud.virtuino.com/virtuino_subscriptions.html.

• You must provide a valid email address and keep your account credentials secure
• You are responsible for all activity that occurs under your account
• You may not share your account credentials with third parties or create accounts on behalf of others without their consent
• Accounts are for individual use. If you need team access, use the multi-tenancy sub-account feature provided by your plan
• You must be at least 16 years old to create an account
• We reserve the right to suspend or terminate accounts that violate these Terms

You agree not to use the Service to:

• Publish, transmit, or store unlawful, harmful, or offensive content
• Attempt to gain unauthorized access to other users' data, accounts, or the server infrastructure
• Deliberately overload the platform beyond your plan's quotas in bad faith (e.g. via automated flooding)
• Reverse-engineer, decompile, or extract the platform's source code
• Resell or sublicense access to the Service without written permission
• Use the Service for any purpose that violates applicable laws or regulations

• Paid subscriptions are processed by Paddle.com, our Merchant of Record. By purchasing a plan you also agree to Paddle's Terms
• Subscriptions renew automatically (monthly or yearly) unless cancelled before the renewal date
• You can upgrade, downgrade, or cancel your plan at any time from within the account console
• Downgrading to a lower plan takes effect at the end of the current billing period
• If usage exceeds your plan's quota limits, we will notify you by email and ask you to upgrade — we do not instantly block your devices
• Prices are listed in EUR and may change; existing subscribers will be notified at least 30 days before a price change takes effect

• You retain full ownership of all sensor data, dashboards, and configurations you create
• You grant Virtuino Cloud a limited license to store, process, and display your data solely for the purpose of operating the Service
• Sensor data is automatically deleted after 365 days regardless of plan (retention policy)
• Upon account deletion, all your data is permanently removed within 30 days
• We do not access, read, or analyze your IoT data for any purpose other than operating and improving the platform

We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance windows will be announced in advance when possible. In the event of significant unplanned downtime (greater than 24 hours) affecting paid subscribers, we will provide a pro-rated service credit upon request.

• The Service is provided "as is" without warranties of any kind, express or implied
• We are not liable for data loss resulting from hardware failure, force majeure, or user error
• We strongly recommend keeping local copies of critical sensor data via the CSV export feature

• The Virtuino name, logo, platform software, and documentation are the intellectual property of the Virtuino team
• You may not use the Virtuino name or logo without written permission, except as permitted by your white-label plan feature
• Open-source libraries used by the platform remain subject to their respective licenses

• You may delete your account at any time from the account console or by emailing support@virtuino.com
• We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity
• Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline in Section 6
• Paid subscriptions are not automatically refunded upon termination for cause; see the Refund Policy

To the maximum extent permitted by law, Virtuino Cloud and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or device malfunction.

Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

These Terms are governed by the laws of the European Union and, where applicable, the laws of Greece. Any disputes shall be resolved in competent courts of the jurisdiction in which the Virtuino team is registered.
